Ontario stretches out deadline for virtual meetings

The Ontario government has extended the deadline for condo corporations to hold virtual meetings and permit electronic voting without a bylaw. The previous deadline of December 31, 2021, has now been changed to September 30, 2022.

Recommendations via Lash Condo Law suggest corporations still proceed with virtual meeting and electronic voting by-laws. “Although we are hopeful that we may soon see a more permanent change to the Condominium Act to remove the requirement for a by-law, it is still important to have a by-law that clearly sets out the basic framework for holding virtual meetings and conducting votes electronically,” said condo lawyer Denise Lash.

She also notes that corporations can continue to send notices to owners by email without obtaining agreements/consents from owners until September 30, 2022, and that there is no need to send any hard copies of notices if the owner’s email is on file.

This change does not extend the time to hold meetings; the previous dates still stand related to annual meeting times.

“All corporations need to adhere to the protective measures that have been put in place to help stop the spread of COVID-19,” stated CCI Huronia in an earlier release. “Providing corporations with the flexibility to host annual meetings and other meetings of significance virtually helps ensure Ontario corporations have choices and can meet their obligations under applicable statutes.”
